My name is Tim Quinn. I have been defending people accused of crimes since 1986. I have devoted my professional life to representing people accused of crimes. Many people are accused of crimes they did not commit and others are charged with more serious crimes than they are actually guilty of committing and need an attorney to work on their behalf to seek justice. I do not handle family law, bankruptcy or any type of law
other than criminal defense. My sole focus is the defense of individuals who are being prosecuted for allegedly committing crime. My office is across the street from the courthouse in Ventura. I am in court almost every day.

Children's rights

A child is a person and not a subperson over whom the parent has an absolute possessory interest. The term "child" does not necessarily mean minor but can include adult children as well as adult nondependent children. Children are generally afforded the basic rights embodied by the Constitution.

Sentencing Alternatives

There are many options available today from the court system. The courts acknowledge a wide range of effective sentencing options between fines and incarceration. With these options the courts have found a solution to improve the ability of the criminal justice system and to also help meet and balance various societal goals. The options and new goals of the criminal justice system include punishment and deterrence, and, where possible, restitution of the victim, and rehabilitation of the offender. In many instances the court will find that public safety may demand that some offenders be removed from society for many years, if not life, but most will eventually return to the community. It is in all of our interest’s that those returning to the community and society be productive and not re-offend. With this in mind my goal is to help you with all options available to you. With the proper information you can make the right decision that will beneficial to you and make the court aware that you are making the proper steps to return to society.

What is an Appeal?

The definition of an appeal is a proceeding by which a case is brought from a lower court to a higher court for rehearing or reconsideration after a judgment has been given by the lower court. When the appeal is brought to the higher court or appellate court, they may sustain, reverse or modify the decision. Most appeals are limited to a review of the record from the lower court. At the appeal the parties cannot introduce new evidence, but are limited to what was said and introduced at the original trial. The appellate court reviews the lower court’s application of the law to the facts as presented at the trial.


How does the Three Strikes Law work?

This law basically relates to any person who commits more than two felonies and can justifiably be considered incorrigible and chronically criminal. This law also provides for the permanent imprisonment for the safety of society.

Driving Under the Influence of Drugs or Alcohol, DUI

I get a lot of questions about the exact determination or the letter of the law when it comes to driving under the influence of drugs or alcohol which most of us term DUI. So let’s review what is Driving Under the Influence.

In the State of California the law states that you cannot operate automobiles, motorboats and industrial equipment etc. if you are so under the influence of drugs or alcohol that you can not safely operate the motor vehicle.

Probation Violations

Many people ask how or why a probation violation is is similar to a new charge. It does differ in several important respects. The first factor is that the alleged violator or violators always appear before the same judge who originally sentenced the defendant to probation. This is the case unless that judge is no longer available. The Second factor and I would say this is the most important thing to remember is that probation violations are not decided by a jury.
